Welcome to College Diamond. These Terms of Service ("Terms") govern your access to and use of the College Diamond mobile application (the "App") operated by College Diamond ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Use of the App

College Diamond provides real-time NCAA Division I baseball and softball scores, play-by-play, rankings, rosters, news, and related content. The App is intended for personal, non-commercial use only.

You agree that you will:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App to scrape, harvest, or collect data for commercial purposes
• Not interfere with or disrupt the App's functionality or servers
• Not use the App in any way that could damage, disable, or impair its operation

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Intellectual Property

The App and its original content, features, and functionality are owned by College Diamond and are protected by copyright, trademark, and other intellectual property laws. The College Diamond name, logo, and all related marks are trademarks of College Diamond.

Team names, logos, and related marks displayed within the App are the property of their respective institutions and are used for informational purposes. We do not claim ownership of any third-party trademarks or content.

4. Sports Data & Accuracy

The App aggregates sports data from multiple publicly available sources including the NCAA, ESPN, and other providers. While we strive to provide accurate and up-to-date information:

• We do not guarantee the accuracy, completeness, or timeliness of any data displayed in the App.
• Data may be delayed, incomplete, or temporarily unavailable due to upstream source limitations.
• The App should not be relied upon for gambling, wagering, or any activity where data accuracy is critical.
• We are not affiliated with, endorsed by, or officially connected to the NCAA, ESPN, or any university or college.

5. No Account Required

The App does not require you to create an account or provide personal information to use its core features. Preferences such as favorite teams are stored locally on your device.

6. Third-Party Content & Links

The App may display news articles, links to external websites, and content from third-party sources. We do not control, endorse, or assume responsibility for any third-party content. Your interaction with third-party websites and services is governed by their respective terms and privacy policies.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COLLEGE DIAMOND, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY REFERENCED IN THE APP; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

9. Indemnification

You agree to defend, indemnify, and hold harmless College Diamond and its developers from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for any reason, including but not limited to a breach of these Terms. You may stop using the App at any time by uninstalling it from your device.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
